This data is obtained for the purpose of managing, providing, expanding and improving the services provided to users, in particular their participation in the forum, as well as, when appropriate, managing the information supplied in applications for registration and press passes made by users

To access certain functions of Ficod.es, participate in the Business Space or access other services, the user shall register by completing the appropriate registration form. The information will contain personal data of the interested party, which must be correct, coherent, complete and truthful. Following this, an account will be created, which the participant will be able to access by means of a username and password. It is important that users keep secure and private their account password, which grants access to the services on this website and allows participation in the Forum. You must notify Red.es immediately if you discover any failure in security or any non-authorised use of your account

The website will send notifications (Newsletter) by e-mail or any other media it deems necessary to inform users about FICOD.

General Conditions for the Business Space

 INTERNATIONAL DIGITAL CONTENTS FORUM (FORO INTERNACIONAL DE CONTENIDOS DIGITALES, FICOD.ES)
  
  
  The following are the general conditions that govern relations between the Public Business Entity RED.ES, with address at Plaza de Manuel Gómez Moreno s/n and operating under Tax No. (CIF) Q-2891006-E, and the users registered with this space.
   Registration with and use of the FICOD.ES Business Space services implies the platform users' full acceptance of the terms and conditions contained in this document.”


  1. Purpose___________________________________________________________________
  
  This interactive Business Space (hereinafter also called 'Business Space') is based on the annual event called “International Digital Contents Forum”. The Business Space, however, has been created as a permanent fixture, designed to serve as a tool for convergence between all people and entities that carry out activities in the Digital Industry, enabling its users to form part of an interactive community that acts as a discussion forum and guide for all sector enterprises and professionals.


 2. Registration requirements and geographic scope___________________________________
  
  The interactive business environment is designed for all those who carry out activities in the digital sector, whether individuals or entities, and especially those who participate in the editions of the International Digital Contents Forum. It is necessary to be of legal age and hold sufficient legal capacity to register. Its geographic scope will be International.
  

3. FICOD.ES services_________________________________________________________
  
  The FICOD.ES Business Space seeks to create the largest directory of digital industry related enterprises, departments, individuals, groups, institutions and administrations.
  The main services the site will offer are as follows:
  -     Directory of people, groups with common interests (for example, video games) and enterprises.
  -     Networking tool.
  -     Private messaging service.
  -     Professional profile creation and modification using syndication tools.
  -     Tools for publishing comments on editorial articles that will appear on the site in the future.


  4. User registration_________________________________________________________
  
  Registration
  At www.ficod.es users will find a section devoted to the 'Business Space' with a registration form where the requested data should be entered. Each user shall choose a username and unique password, which will validate their access to the system. Users will be exclusively responsible for safeguarding said password, holding RED.ES harmless from any damage that could result from its loss or theft.
   
  The data provided by users must be correct and truthful and RED.ES reserves the right to refuse or cancel the registration of those who do not meet these requirements.
   
  Acceptance of terms and conditions
  Users must accept these terms and conditions to complete the registration.


5. Profile creation____________________________________________________________
  
  Profile
  Registered users may create their own profile, which shall contain the following information:
  -     Name and surnames
  -     Post and company
  -     Profiles in social networks
  -     Sectors and activities of interest
  -     Sectors and activities in which the user participates
  -     Short biography of the user
  -     Photograph
  -     Profiles in the social networks
   -    Contacts
   Users may also provide photographs, videos and comments; participate in the FICOD.ES forum, as well as linking with other social networks where they are registered.
   
  In any case, users may always modify their profiles.
  
  Privacy levels
  Registered users may choose from 2 privacy levels:
  
  1) Private level. This option enables users to keep their profile strictly confidential and visible only by them.
  
  2) Public level. This option allows user profiles to be completely public, with all registered users having access to all personal details (except for telephone numbers and e-mail addresses), as well as other content such as photos, comments, etc.
   
  RED.ES and FICOD.ES may create other privacy levels in the future, on which users shall be duly informed.



6. Terms and conditions of the interactive scope of the FICOD.ES Business Space___________
  
  Intellectual property of content
  When using their personal profiles, users guarantee that they are the owners or have obtained the corresponding assignment rights from the authors of the content uploaded to the profile, including photographs, texts, videos, presentations and, in general, any other content that may be subject to protection under Royal Legislative Decree 1/1996 (Real Decreto Legislativo 1/1996), dated 12 April, approving the Consolidated Text of the Spanish Intellectual Property Act. RED.ES assumes no liability whatsoever for any damages that may result from unauthorised use of protected material, users being solely responsible for the content they provide. Likewise, users are responsible for all content that may be protected under industrial property regulations, guaranteeing that they are the authors of the material protected by said regulations uploaded to the profile or that they have obtained the corresponding permits for said material. Therefore, RED.ES assumes no liability whatsoever for any claims or damages that may arise from the unauthorised use of the aforementioned material.
   
  Users assign their content use rights, particularly the rights for reproduction, distribution, public disclosure and transformation, without any consideration, for the entire period permitted by the intellectual property laws, world-wide and for the sole purpose of publishing them on the FICOD.ES website.
    
  Image rights
  Users assign their image rights, for no consideration of any kind, so that their image may be reproduced and disclosed, both via photographs or videos that they upload to their personal profile, as well as in respect of any format in which said image may be contained. Likewise and under the same conditions, they assign their image rights so that RED.ES may promote the professionals' space on any media and in any format.
  
  For any third party claim referring to image or intellectual or industrial property rights, contact the Public Business Entity RED.ES by ordinary mail to Plaza de Manuel Gómez Moreno s/n or via e-mail at contacto@ficod.es.
   This will lead to application of an action protocol in which the alleged infringing party will be given 5 calendar days to present their defence or remove the content in question.
  
  Code of conduct
  In the use of their personal profile, users' conduct must be befitting to the Business Space. Specifically users must abstain from carrying out any action that other users may find offensive, whether they be sexist, racist or homophobic attitudes, actions that incite violence or denigrate third parties, including legal entities, and in general any other action that could disrupt normal coexistence or which could damage the image of the Business Space, RED.ES or FICOD.ES. RED.ES reserves the right to automatically withdraw any type of content that does not comply with the aforementioned requirements, as well as to cancel the registration of users who infringe the respective rules.
  
  Users may not use the different tools provided by RED.ES for mass mailings or sending SPAM. RED.ES assumes no liability whatsoever for any damages that may arise in this respect.
   
  Users shall abstain from using the site indiscriminately as an advertising platform
    
  Links.
  Users are solely responsible for any links included in their personal profiles. RED.ES declines any responsibility for the content of linked pages. RED.ES reserves the right to remove any links that could be detrimental. Unless expressly stated otherwise, RED.ES has no kind of contractual or commercial relationship with the linked sites.
  


7. Liability limitations_______________________________________________
  
  RED.ES and FICOD.ES assume no liability whatsoever:
  
  1. For any type of damages that may arise as a result of incorrect or inaccurate data or failure to update said data.
   
  2. For any unauthorised or fraudulent use of the respective password. In this respect, the platform's users are solely responsible for the safekeeping and use of their passwords
   
  3. In the event that users link up to other social networks, they shall be responsible for the content therein, personally observing the terms and conditions established by said networks.
   
  4. For the type of information, data and content that users provide to the system, giving no guarantee as to their truthfulness and/or accuracy. Notwithstanding the foregoing, RED.ES shall use the corresponding tools to neutralise or reduce any damaging effects that may arise from said content, and it may automatically remove, offering no type of consideration whatsoever, any information, comments, audiovisual material or other content that may be detrimental to third parties, especially when there have been infringements against intellectual or industrial property or against image, honour or privacy rights.
   5. For any possible technical failures in the telecommunication networks or the website that prevent access thereto.
  
  6. For any temporary or permanent loss of the content uploaded to the system by users. In this respect, RED.ES shall not be obliged to replace said content or compensate its loss and, therefore, users are recommended to keep a copy of said content.
   


8. Reserve of rights_________________________________________________________
  
  RED.ES reserves the right to automatically cancel, without giving any reason, the registration of users who enter false data or who misuse the service or who break any prevailing laws using any means provided to them. Likewise, it reserves the right to refuse to register users when they are suspected of providing false data or having different objectives to those for which this space is designed.
   
  RED.ES shall moderate the Business Space and may not permit or automatically delete any comment that contravenes socially and legally accepted standards.
   
  RED.ES shall take whatsoever appropriate legal action against the use of fraudulent mechanisms that disrupt the service's proper operation. Specifically, and by way of non-limitative example, users may not use software, scripts, Robot/Crawler technologies and, in general, any other system that affects the system's operation and transparency.
   
  RED.ES may change the terms of these conditions at any time, duly notifying users.


9. Personal data protection_______________________________________________
  
  The personal data collected by RED.ES shall be used to manage the services and applications offered on the Business Space, and in particular participation in the different editions of the International Digital Contents Forum.
    
  The registered data shall be held in a file in the terms established under Organic Law 15/1999 (Ley Orgánica 15/1999) dated 13 December, the Spanish Personal Data Protection Act. RED.ES declares that it has implemented the technical and organisational data protection measures pursuant to Royal Decree 1720/2007 (Real Decreto 1720/2007), dated 21 December, which approves the Regulations that implement Organic Law 15/1999 (Ley Orgánica 15/1999) dated 13 December, the Spanish Personal Data Protection Act.
  
  In compliance with the Spanish Information Society and Electronic Commerce Services Act, when registering users may choose to expressly authorise RED.ES to send them, even by electronic means, information on its conferences and services. In any case, they may cancel the electronic communications by notifying contacto@ficod.es, stating BAJA (cancel) in the subject heading and specifying which medium they wish to cancel: e-mail, SMS, MMS or all of them.
  
  Users are informed that if they choose the 'Public Level' of privacy, their data may be seen by all registered users, except for their telephone and e-mail. If you do not wish your data to be seen, select the 'Private Level' option, or request cancellation of the service. Under no circumstances may users access data of other registered users for purposes other that those of the Business Space, nor may they disclose them to third parties without express authorisation from the user in question.
   
  
  To exercise their rights of access, rectification, opposition or cancellation in respect of their data, users must send a letter, together with a copy of both sides of their Spanish National Identity Card (DNI) or passport and with the reference 'DATA PROTECTION' to the Public Business Entity RED.ES, with address at Plaza de Manuel Gómez Moreno s/n.
    

10. Registration cancellation____________________________________________________
  
  Users who wish to cancel their registration to the service must request it via e-mail sent to the following address: contacto@ficod.es
  Also, by marking the check boxes on the form, users may cancel:
  -     E-mail communications
  -     Mobile telephone communications
  -     Publication of their profile in the Business Space
   

11. Applicable legislation and jurisdiction___________________________________________
  
  These legal conditions shall be governed by Spanish legislation.
  The parties declare that, waiving any other jurisdiction that may correspond, they shall accept the jurisdiction of the Courts and Tribunals of Madrid to settle any questions that may arise in the application or interpretation of these terms and conditions.
